I am working in a security services company. The company is holding original education certificates (10th class & Plus two) of all employees for a period of three years. Could anybody help me? Is there any right to hold original education certificates by the company? How can an employee approach court?

No one has the authority to retain the original education certificate of an employee. However, since it is a security company, they may have taken it into custody as a form of control over the employee. Instead of going to court, ask the employer to return your certificate. There can't be any binding agreement that forces you to work with them for a specific period. If they refuse to return it, you can contact the police or take legal action.

I agree with Jiten that they have no authority to keep these originals but differ with this custody procedure because there are a number of instances where an employee needs these originals. Without the certificate, he/she won't be able to perform the same tasks. Please go to your immediate supervisor or boss, tell him/her your story, and try to retrieve your certificates. You can explain that you need these certificates for further study and must submit them to the educational institution/college for admission purposes. If they refuse to return the certificates, you can consider taking legal action, as Jiten suggested.

Please guide me. I too have the same kind of issue. I have submitted my 10th, 12th, and UG degree certificates to my previous employer. I've also signed a bond for 2 years. However, due to verbal harassment by another Team Leader, I absconded from that company. To retrieve my certificates, I have to pay a certain amount as per the agreement I signed. Unfortunately, I am not in a position to pay such a lump sum. Is there any other way that I can retrieve my certificates? Additionally, the bond is set to end this September, but I have only served 6 months there.
Please help me resolve this situation.
