1) If a company does not give an employee NOC, and if he gets a ban from labor of 6 months, is there any other way he can lift the ban? I'm talking about an employee who has finished 1 year of service only.

I am Hari, working as a BDM in Bangalore. I was working in Dubai; due to my father's health condition, I was forced to come back to India. I did not cancel my employment visa in Dubai. Now I have planned to go for higher studies, and I wanted to know whether it will be an issue since I have not cancelled the visa. Will it affect my career if I am planning to go to some other countries? When I asked my company, they told me that if I am not returning back in 6 months, the visa will get automatically cancelled.

There could be a chance of him getting a ban if the sponsor does not give him an NOC. He has to amicably request them to give him an NOC or pay them any compensation. In this way, an NOC could be given.

If you have a work permit visa in the UAE and stay in the country for more than 6 months, then your visa will be automatically canceled, and your passport details will be forwarded to immigration for a lifetime ban.

Mildred, what they go by is the date of stamping on the visa. I too have come across instances of something similar.

Well, hi all.
I have spent some time in Dubai, as a matter of fact, the past 6 1/2 years. I could maybe contribute to the discussion.
A) Dubai is currently following an outdated labor law, but it is now under revision and available for all to see on the UAE Ministry site.
B) As far as bans go, all canceled visas immediately and automatically receive a 6-month ban unless an NOC is provided by the employer.
C) Further, in case a 6-month ban is imposed, a visit visa is usually taken for the candidate and then renewed after 3 months. Trips to Kish for junior management and to India, or as applicable, are usually done for the visa change.
D) In the event that an employer files an absconding report at the labor department in Dubai, proper justification and proof are required. Sometimes people are on vacation or the company sends them for projects outside of the UAE; if an absconding report is filed, the person is banned from entry into the UAE (all 7 emirates) for life. Before computerization, people used to enter through other emirates, so there is no chance of a visit either.
E) If a one-year ban is imposed, at least in Dubai, the company needs to be very powerful and have excellent contacts. If not, the labor department does not accept it. Because in the event of a one-year ban, the person cannot enter the UAE on a visit; it goes to the immigration department, so no entry is possible.
F) With reference to an article in Gulf News from 4 months ago, there is no comprehensive mention of bans in the labor laws. It seems that the labor department themselves are confused about this.
G) Lastly, labor laws are different in free zones. There, there are no bans, and you can change companies provided the contract is fulfilled.
H) Even during probation, companies that sponsor the visa have the right to ban the employee, which is what many companies do.
I) To combat such practices, the Mission visa is now instituted in Dubai labor, where a person is given a visa for four months, and depending on the contract between the company and the individual, even family members can be brought to the UAE. This is good for short-term projects or for top positions during probation.
Now, after having said all this, I also have to inform you that there are companies owned by the government that are not even registered with the labor department. Yes, this is true. They do not have any of their employee contracts registered with the labor department because they are government-owned or, as I call it, semi-public, as government companies now seem to have IPOs that are grand! You would not believe this, but these companies can do what they want. They deal directly with immigration, and an employee who has been wronged cannot go to labor because the labor department says they are not registered with us and do not come within our jurisdiction!
Lastly, there is also preemptive visa for government and semi-government companies. In the event that they need you, they will ask if your current company is going to ban you when you leave. If you say yes, they will provide something called a preemptive application! You wouldn't believe it, but with this application, when the current company cancels the visa and tries to impose any ban, they will be informed that the person has been transferred to another visa. Hence, the preemptive application, but this is only possible for government and semi-government companies.
At the very end, as long as the company is not semi-government or an extremely powerful entity, there are sources through which even a one-year ban can be removed. Unfortunately, I cannot disclose these sources, but they are available in Dubai. Basically, the record of your ban will be erased, and you can apply for a visa again.
As for the 6-month ban, the option is to get a visit visa or, in the case of big companies, they provide a letter to the labor department to have the ban removed.
Well, I hope all that was useful. I will do my best to provide more information where possible.

There would be no problem for you as your employer would cancel your visa themselves as it is compulsory as per UAE law to cancel the visa. One more reason to cancel your visa is that they would get back the visa deposit amount from the labor office.

As per Article 25, "the maximum working hours for children shall be 6 hrs a day." But one of the persons working in UAE states that no child laborers are employed in UAE. Is it true? However, as per Article 25, it means child labor can be employed.
Does child labor exist in UAE or not? Also, is there any minimum wage fixed by the UAE government? If so, what is the minimum wage? Otherwise, what is the lowest wage that is being paid for workers and staff?

Hi, I joined today.
I was working in Dubai for 3 years. I planned to open a company in Dubai and was searching for a PRO. Finally, I approached a PRO, unfortunately, he was my company's PRO. I dropped the idea of joining that PRO for my business. Things were going fine. I decided to resign from my company and got a new and best offer in my hand. I was happy. One fine day, I met the PRO with my boss, and then my boss came to know about my idea of opening a company through that PRO. The problem started. He didn't give me an NOC and lodged an absconding complaint against me. I fought in the labor court, the decision was in my favor (I felt that time). I got banned for one year. After 1.5 years, I got a good offer in Dubai, and I got an employment visa as well. When I landed at Dubai airport, I came to know that I had a lifetime immigration ban.
My questions are:
1. Why did I get a visa while a lifetime immigration ban was in place?
2. Is it possible to waive (lift) a lifetime immigration ban? If yes, how?
3. Is immigration banned for all seven emirates?
4. Why did I get a lifetime immigration ban once I proved that I am not absconding in the labor court?
5. Why didn't they tell me that immigration is lifetime banned? Why did the labor court deceive labor?

I want to join another company. Right now, I am working on a probation period of six months as per my employment contract. What are the options open for me to get a new job without facing a ban? Is there an easy way to avoid at least a six-month ban, or can I pay a job lift ban amount to remove the ban? I am a diploma Mechanical engineer, and my designation on the visa is quality controller.

I want to leave my present job. I am not happy with my working environment and surroundings. I am getting a nice offer from another employer. So, how can I leave my present employer and transfer my visa if he is not providing me with an NOC? Or, if I resign now, I am on probation for 6 months, of which I have completed 2 months. How many months or years of a ban will I get, and can I lift the ban? Is it possible for a diploma mechanical engineer? Otherwise, I must work for at least 1 year so that I can easily lift the ban. Recently, two guys have been recruited, and I was trying to lift the labor ban for them. I came to know that if you finish a 3-year contract, you can lift the ban with a new employer. If you have a ban due to canceling the visa before 3 years, then you need a No Objection Certificate (NOC) from the company you were working for. Only then can your new employer lift the ban. However, please note that if you renew the contract for the next 3 years, you need to fulfill that contract.
This ban will not affect you if you join a company in a free zone.

Termination of a contract during or at the end of probation can be done without notice. In such a case, neither of the parties (the one which canceled the contract) is liable to pay any reimbursements or fines. However, if the contract is limited (maximum 4 years) and the employee breaks the contract before its completion, then he is subject to a one-year ban, plus compensation payable equal to one and a half months' salary for three months or the remaining period of the contract, whichever is less, and non-payment of end-of-service benefits.
If the contract is unlimited, then with one month's notice, you can leave the service. An automatic labor ban of six months shall be applied. If you have completed one year of service, you are eligible for gratuity, which shall be 21 days for each completed year, without the need to pay any compensation.

Are the laws in Dubai different from Ajman? Hey, I'm working in Ajman but intend to take up another job in Sharjah or Dubai for that matter. My query is that I have almost 2+ years of experience in this field now, but all visa issues I deal with are as per Ajman law. So, guys, is there any change when the emirate changes? I mean, will this experience help me in my next job? Please guide.
