I work for a fast-food restaurant chain in Bangalore. We are registered under the Shops & Establishment Act and the Factory Act. We regularly file all the ESI and PF returns. Currently, we are required to submit Form U for Labour Return in the month of January. Could you please let me know where I can obtain this form and explain the purpose of this form?

Hi,

You can obtain Form "U" from Karmika Bhavan (Labour Office). It contains:

1. Payment of Wages Act
2. Maternity Benefit Act
3. Contract Labour (R&A) Act
4. Man-days & Man Hours (Total number of days worked by men, women, and children)
5. Child Labour Act
6. Bonus Act
7. Earned Leave
8. Annual Wages (paid)
9. Resigned Employees.

Form U needs to be filed online. You need to apply for your user ID and password from the labor department, and you can upload the return. You can obtain an acknowledgment for the return, and the return will be verified and accepted by the jurisdictional Labor inspector. Dear Seniors,

I have to fill Form U, and I am stuck on Serial Number 6A. Please help me with the following three queries:

1. "No. of Days worked": How do I calculate the number of days worked out of 365 days?
2. "No. of man days worked during the year": How do I calculate the number of Man Days Worked?
3. "Total Amount of salary / wages paid including O.T. wages and Allowances": In this cell, should I mention Gross Salary or Take-Home Salary?

Please help me to resolve these issues.

Dear Anand Prakash,

Please note the reply:

"No. of Days worked" = This will include the number of days for which the establishment worked during the period. First, consider a full year of 365 days, then deduct the number of days for which the establishment did not work (such as days off and holidays). Please note that if the data is related to any of your project sites where round-the-clock service is provided, then it will be considered as 365 days.

"No. of man-days worked during the year":
This includes the number of days for which duty was performed at the site/office by the personnel. Only present days will be counted. For example, if a person received wages for 30 days in a month (including 8 days off, 1 holiday, and 2 leaves), then the man-days for the month for that person will be 19 man-days (30 minus (8+1+2)).

"Total Amount of salary/wages including O.T. wages and Allowances":
This includes the gross wages before deductions for PF-ESI, PT, etc.
