Hi Learned Members,

In a case study, the termination of services of an employee is abrupt, unfair, and illegal. Under duress and predicament, the aggrieved employee receives dues and signs the full and final paper.

However, there is injustice done to the employee. Can he claim compensation for mental agony, loss of reputation, and employment later?

If the employee is able to prove that the resignation has been obtained under duress, the Court can set aside such termination of service and order for reinstatement. In labor matters, there is no compensation for mental agony or loss of reputation, but the court can order for reinstatement and back wages.
