If the employee serves the proper notice period as per the appointment terms, he/she can be relieved properly.
However, if the employee partially serves notice at the discretion of the employer, the balance notice period days can be recovered from the employee's salary.
If the employee does not agree to the proper notice and also does not accept to make payment in lieu of the notice period, then it will result in termination of employment, and he/she will not be eligible for proper relieving.

Management can initiate action based on the terms and conditions mentioned in the appointment letter (separation clause) of the concerned employee. You can adjust the notice period salary from his F&F settlement or ask him to deposit the same before issuing the relieving order and releasing his F&F dues.
