किसी कंपनी में (25) से अधिक कर्मचारी कार्यरत है और कंपनी ने भविष्य निधि में रजिस्ट्रेशन नहीं लिया है तो क्या क़ानूनी कार्यवाही कंपनी के मालिक पर हो सकती है ? और यदि वो अब P.F में रजिस्ट्रेशन लेना चाहे तो क्या जब से कंपनी स्थापित हुई है तब से P.F के बकाया को जमा करने की आवश्यकता है या फिर (वर्तमान) जब से उसने रजिस्ट्रेशन लिया है?


And in the Employees' Provident Fund & Miscellaneous Act, 1952 said that this act does no apply to - (A newly set up establishment for an initial period of 5 years )

How far the above mentioned statement correct please tell me....

There is no waiting period of five years in the applicability of the PF Act 1952. It is applicable from the day your employee strength has been 20 or more. Be prepared to produce documents like attendance record, wage & salary register , annual financial statement etc. to substantiate your claim on the date of applicability of the Act. If you are caught being non-compliant of PF Act, then the consequences can be very serious.
