I worked as a Manager of Accounts in a Private Limited Company from July 2006 to September 2017. In July 2017, I applied for maternity leave. Initially, they said I could work from home. However, in mid-September, they informed me that it was not possible and that they needed to hire someone to replace me. They also mentioned that they might rehire me after six months as someone else was already working in my position. Essentially, they terminated my employment. I left the company on 30th September 2017, as per my initial application. They did not pay me any maternity leave salary or gratuity. Please advise on what steps I should take.

Hi, After a lapse of 2 years, you are raising this query. It would be prudent on your part to raise this with your employer by July 2017 itself. You claim that they have terminated you silently. What was the reason mentioned in the termination letter? Anyhow, you can still talk to them and request to release gratuity. Send the request letter through RPAD. In case of no response, you can file a case with the Labour Officer of your jurisdiction. If you have any copy of the request letter sent to your employer in the year 2017, attach the same in the complaint letter to the Labour officer to prove that gratuity was denied. You can claim delayed gratuity with interest amount.
