Provident Fund and Gratuity Act are separate Acts. If the Gratuity Act is applicable to your company, then you are legally liable to pay gratuity to employees based on the rules and regulations of the Gratuity Act.

Dear friend,
Provident Fund, Pension, and Gratuity are the "Triple Terminal Benefits of Employment." Therefore, the statutory application of the EPF Act, 1952, or the voluntary extension of such similar benefits by the employer cannot take away his obligation to pay gratuity to his employees on termination of their employment under him once the Payment of Gratuity Act, 1972, becomes applicable to the establishment.
