Advice will be highly appreciated as mentioned below:

1. If any employer pays a bonus of 20% (because they are bound to pay if the allocable surplus is higher than the minimum payable bonus) as per the bonus act.

My query:

1. Suppose we pay the maximum bonus in a year, and after the next 3 years, there wasn't any allocable surplus. Can we then reduce the percentage of the bonus and pay the minimum bonus (8.33%) as per the legal point of view?

Yes, you can do that. For more clarification, please refer to section 15 of the Payment of Bonus Act. Also, see what the amount available as "Available Surplus" is according to the act.
