i am 8 + months pregnant and a confirmed employee of an insurance co. now company is asking for my resignation when few days are left for my maternity leaves. kindly suggest what can be done.

Hi,

Congratulations on becoming a mom or a new mom! It is highly offensive to ask for your resignation if you have served at least 9 months with the company. Clearly state that you have the right to receive maternity benefits and request the company to provide them. If necessary, please visit your labor welfare officer or ESI officer. You are entitled to 84 days of basic pay along with a delivery cash benefit of 1000.

After delivery, consider returning to the office for at least a couple of days before deciding on resigning from your job, if you choose to do so. May God bless you!

Since, under Section 12 of the Maternity Benefit Act, it shall be unlawful for an employer to discharge or dismiss a woman during the maternity period, please send a letter to the Registrar of the High Court to place it before the High Court and to treat it as a writ petition during your maternity period in order to quash the illegal discharge.

RELAX, no employer can force you to resign, certainly not because of the pregnancy situation. As rightly mentioned above by our fraternity members, you have the right, and the employer has to grant you leave as per the act. You may extend the days (after the delivery) by using your earned leave (PL) (if you have it with you), but be careful to file/apply for the leave on time so that you do not give any opportunity to your employer to label your absence as a case of indiscipline.

There are ample legislations under which you can raise a complaint. Just be careful that you are punctual for all the days that you put in at work and preserve your official documents (since it could be required in support of your continuous employment) like appointment order, increment letters, salary slips, annual PF statements (Form 23), etc.
