Hi,

It is a declared national holiday apart from the 15th of August and 26th of January. If your industry is of a continuous nature where closing down is not possible, you will have to pay three times the salary/wages to the employee on such a day.

As you mentioned, for a national holiday, if our industry operates on a continuous process, we are required to pay three times the wages. I encountered this issue in a cement industry that falls under continuous processing. However, as per the UP Establishment National Holidays Act, 1961, if work is undertaken on a national holiday, we must pay double the wages for that day. Alternatively, the employee may opt for wages for the day worked and a substituted holiday with wages within the following month, excluding weekly holidays.

can anyone tell me how many day can a factory be working continuously as per factories act. Is it 9 or 10 days

I wanted to address the simple concept of a national holiday. Employees are entitled to receive their regular wages for the national holiday, and if they are required to work on such a day as overtime, they should be compensated at double their regular rate, amounting to three times the normal pay. I hope this clarifies the issue.

Dear Mr. Kaushik,

Thank you for your comments, but I have already discussed this issue with the Dy. Lab. Commissioner and the Secretary of the union. Ultimately, we are required to pay double the wages for a day or, alternatively, provide wages for that day to the employee as well as a substituted holiday with wages falling within the next calendar month, excluding weekly holidays. This decision has been made.

Hi,

This is good information!

I would like to know if this is applicable to call centers as well. In call centers, I have seen that we have to work on public holidays and we can get a comp off later on, which again depends on availability. If you do not take a comp off, no additional wages are paid.

What should be done in this case? Please reply.
