Dear Friends,

How is prenatal maternity leave considered? If an employee requests maternity leave for a duration of 8 weeks prior to the expected date of delivery, how do we adjust the 12 weeks? The organization would like to extend 12 weeks of maternity leave only.

Hi,

The total is 12 weeks. If the employee requests 8 weeks of prenatal leave, we can ask them for a doctor's certificate regarding their health condition, and we can provide them with 4 weeks for postnatal leave.

Hi Kavita,

But the law clearly states that:

(1) No employer shall knowingly employ a woman in any establishment during the six weeks immediately following the day of her delivery or her miscarriage.

(2) No woman shall work in any establishment during the six weeks immediately following the day of her delivery or her miscarriage.

Hi Rekha,

Please note that she is working in the organization. I don't know if she was working better or not. However, from my perspective, please grant her an additional 5 months of maternity leave and seek permission from the director. In my company, I have done the same for the receptionist.

Regards.
