Hello!

How can an employee claim the benefits of ESI after getting into an accident on the way for company work? Could you please specify how the employee can claim all the benefits of ESI? I would like to know all the details about this.

Dear Mr. Lakhan,

For accident cases, you can admit the employee to the nearest hospital, preferably to a Govt hospital. Immediately contact your ESI Local office and file the accident report. Once they accept the same, you can either put the employee in the same hospital if they allow or else you may have to shift him to the hospital prescribed by the ESI Doctor.

Once ESI admits the case, you will get all treatments free without any limit. But in case the treatment needs admission in a specialized hospital, this also needs to be given in writing from the ESI Doctor concerned. Please note immediate reporting of the accident is a must. Otherwise, the employee will lose the claim.

Please resolve the following doubts with respect to ESI:

1. From which day does an employee start getting ESI benefits? What if he meets an accident on the day of his joining?

2. Is the employee's and employer's contribution towards ESI calculated on what is payable or what is actually paid? What will happen in case the employee is absent for the entire month?

3. Is the employee eligible to get ESI benefits post his retirement? If yes, for how long will he continue to get this benefit?

4. If an employee was initially getting Rs. 14,000 in company A and was hence paying ESI contribution. Now, he resigns and joins company B at a salary of Rs. 16,000; so he stops paying ESI contribution. A week after he joins company B, he meets with an accident/gets sick and is hospitalized. Will he get ESI benefit? If yes, for how long will he continue to get this benefit.
