Construction Industries - BOCW Act, 1996
Normally in construction industries, we used to follow the Contract Labour (R&A) Act, 1971, and we take a Labor License before commencement of a construction job. In that Act, details are typically given about the contract workforce, obtaining labor license procedure, welfare measures, and all about the contract workmen. The government felt that the act does not have uniqueness.
Hence in 1996, the government introduced the Building & Other Construction Workers Act (in short, BOCW Act), BOCW Rules, and BOCW Welfare Cess Act, BOCW Welfare Cess Rules. In the BOCW Act & Rules, it provides directions about welfare measures to workmen, safety precautions, and many technical aspects about tools, tackles, instruments, machineries, lifting appliances, maintenance, inspection, etc. Medical facilities required to be given to injured workmen, periodical medical check-up for drivers, operators, food handlers, etc., pre-employment medical check-up for every workman. It is required to be inspected by a technical person. Hence, a Factory Inspector has been empowered to act as a BOCW Inspector.
For implementation purposes, the government needs funds. So, they implemented the BOCW Welfare Act, which made provisions to collect a minimum of 1% and a maximum of 2% of the cost of construction/works carried out during the financial year to be paid as BOCWW Cess to the BOCWW Cess Board.
Now the funds are being collected from the construction industries, but how to spend the same? A million-dollar question arises. Hence, the government made one more provision that the workmen engaged in construction activities will be registered as beneficiaries of the fund duly generated, and they made rules to issue the Beneficiary Cards/BOC Worker Identity Card to the workmen working on construction sites after obtaining the Application Forms + Age/Name/Address/Family Details Proof + Fee for Registration (In AP, it is Rs.62 in the first year and every year Rs.12 as a renewal fee & in Gujarat Rs.100 in the first year and every year Rs.75) as fixed by the Act as not exceeding Rs.50.

I do not think there will be any problem in opening a Savings Account in a Post Office nearer to his hometown. Normally, they never ask for any proof. Furthermore, it is intimated that the Address Proof is readily available if any person approaches the nearest post office to his residence. Without knowing the identity of workers, why should you employ them? As an employer or principal employer (if you engage workers through a contractor), you should know their place of birth, the police station they belong to, etc. This is very important because there are a lot of cases involving migrant laborers in terrorism, theft, rape, and other antisocial activities. Remember that we are supposed to register and file certain returns under the Interstate Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979, if we employ five or more migrant employees. The primary purpose of the Act is to "REGULATE" such employment. Therefore, avoid engaging any employee if you are not satisfied with their identity.

I would like to clarify that the ESI Act is not applicable to construction industries, nor to the BOCW Act. Registration under the BOCW Act is exempted for those already covered by the Factories Act and Mines Act. Construction work carried out for self-use, where the cost is within 10 Lakhs, falls under this exemption.

What is a Color Contract? Are you referring to a Painting Contract? All the workmen are to have PF deducted.
Whether Electrical Contract work applicable under EPF act.
All contractors are to pay EPF for the workmen engaged by them.

Even the workmen who worked for 1 or 2 days are also to have EPF deducted. (Please refer to Section 16 & 17 of EPF & MP Act, 1952.)

Please help me in explaining who is supposed to take a license under the BOCW Act 1996. Kindly read the definition of Employer in the Act. It states "employer" - in relation to an establishment, means the owner thereof and includes:
(i) in relation to a building or other construction work carried out by or under the authority of any government department directly, without any contractor, the specified authority, or if no authority is specified, the head of the department;
(ii) in relation to a building or other construction work carried out by or on behalf of a local authority or other establishment directly, without any contractor, the chief executive officer of that authority or establishment;
(iii) in relation to a building or other construction work carried out by a contractor or by employing building workers supplied by a contractor, the contractor.
If a government authority awards work to my company, and my company further contracts the work to another company that actually performs the work on-site, who should obtain the license under the BOCW Act? Is it my company or the contractor company to whom we awarded the work? In my opinion, and according to point (iii), it is the contractor who is conducting the work on-site that should secure the license.

Please fill out the application form (Form I) again. In Column No. 6 of the application, specify the maximum strength you would like to increase, and in Column No. 8, specify the estimated date of completion. To support your date of completion, attach the Work Order issued by your PE. Then, pay the license fee (difference) and prepare a covering letter mentioning the amendment in the Registration of Establishment under the BOCW Act, 1996.
There is no separate form for amendment/renewal like the CLRA Licence and ISMW Licence. You must use the same form that is used for a new Registration of establishment application.

As an MEP vendor in the Construction Industry, which is covered under the BOCW Act, do they need to register under the BOCW Act? Do they need to pay cess for construction jobs? Or is only the Civil vendor responsible for cess under the BOCW Act?

Greetings of the Day!
As an MEP vendor in the Construction Industry, which is covered under the BOCW Act, do they need to register under the BOCW Act? Do they need to pay cess for construction jobs? Or is only the Civil vendor responsible for cess under the BOCW Act?

As a matter of fact, the Principal Employer, Contractor, and Sub-contractors (in some states) who are involved in any construction activities including MEP (Electrical, Plumbing, Firefighting) are required to get registered under the BOCW Act. The Cess part will be taken care of by the Principal Employer and not by the Contractors & Subcontractors.

2. Minimum Wages Act, 1948.
3. Payment of Wages Act, 1936.
4. Payment of Bonus Act, 1965.
5. Payment of Gratuity Act, 1972.
6. Employees' Provident Funds & Miscellaneous Provisions Act, 1952.
7. Employees' State Insurance Act, 1948.
8. Workmen's Compensation Act, 1923, and Fatal Accident Act, 1885.
9. Contract Labour (Regulation & Abolition) Act, 1970.
10. The Maternity Benefit Act, 1961.
11. Local Municipal/Corporation Building Rules, if any.
12. National Festivals & Holidays Act, if applicable.
13. House Rent Allowance Act, if applicable for the State.
14. Labour Welfare Fund Act, if applicable for the State.
15. Pollution Control Board Act & State Rules, for Consent to Establish and Consent to Operate.
