Every month, my employer disburses employee salaries after the 10th. However, to date, my November '10 salary is being held by my higher authority without any notice, intimation, or reason provided.

What legal actions can be taken against my employer? Please advise me on this matter.

Mr. Somnath, firstly, you need to ask your supervisor and your personnel why your salary has been withheld by them. There must be a strong reason behind this because otherwise, no one can stop your salary. Without consulting your immediate supervisor (your boss), your personnel and HR department cannot hold your salary.

You just need to find out the reason for the same and speak with your boss first. Later, approach the HR department and ask them to provide you with the specific or accurate reason for this. Never jump to a conclusion and decide to take legal action against your employer. Be polite and don't hesitate to approach your superiors and HR personnel.

Approach your superior without prejudice through the proper channels. Avoid going directly to the Board Director or Managing Director with a complaint as it may lead to ongoing problems and potential traps at every level. Instead, contact your section in charge and the HR Department.

Politely inquire about the reason for the non-payment in November 2010. Ask for clarification on any deductions or recoveries that may have affected your payment.

Avoid considering legal action as your first course of action.

Dear Sir/Madam,

Regarding our previous conversation with my HR person, her reply was: "Your contract is over on the 14th of December 2010, and we regret to inform you. However, based on the verbal instruction of my boss, I continued my service. Up to this date, they have not paid my salary for November, December, and January. On the 1st of February 2011, I submitted my resignation via email and registered post.

Please advise me on the necessary legal steps to recover my salaries and other pending benefits. If I were to pursue legal action, under which act can they be implicated? What actions should I take for a prompt resolution in recovering my due money?
