Hi all seniors,

Please guide me -

a) I have already obtained registration of contractors who are providing us with labor.

b) Now, one of the contractors has changed, and a new contractor has joined, providing more than 20 laborers.

Due to the changes in the registration certificate resulting from the change in contractors, should I obtain a new Registration Certificate from the Labour Commissioner?

Hi,

Yes, you need to renew your certificate now that you have new contractors added. The contractor needs to deposit an amount of Rs. 50 for each laborer, and it is refundable. Please visit your nearest LO so that they can guide you in the right direction.

Hi,

As I know, Registration as per CL (R&A) Act is given for employing contract labor on certain jobs (in which the Principal Employer wants to deploy contractors, except for those which are prohibited), and a list of Contractors is attached with the Registration certificate. So, I think if only the Contractor changes and not the job changes or inclusion/exclusion of the job is done, there is no need to amend your registration. Only Form VIB needs to be sent, and an intimation is required to be given as per Rule 18 (4) of the Contract Labor (R&A) Rules, towards the inclusion of a new contractor.

I have a canteen contractor, and their total manpower is only four. Please suggest whether I should update the same in the Contract Labour Registration Certificate and if they are eligible under the Contract Labour Act.

Dear Parvathi,

If the total number of workers of the canteen contractor is only four, even then you are required to get the amended registration certificate from the Registering Officer. Give notice of the change to the R.O. for amendment as per the procedure laid down in your applicable rules. On the other hand, the contractor is not required to take any license under this Act as they are not employing 20 or more workers.
