Dear Senior,

I just want to clarify some points with you. I joined my company in Jan. 06. In my appointment letter, I am eligible for 2 bonuses: one is Loyalty and the other is Performance. I received my loyalty bonus in Jan. 07, but due to some reasons, the company postponed the performance bonus to March 07. Now, I am leaving this company on 20th March 07. I have given 19 days' notice and made a payment for 12 days to the company. However, the company informed me that I am not eligible for the Performance Bonus because they added a point in the Employee manual stating that an employee must be present on the day of the bonus payout to be eligible.

What do you think? Is this right?

Hi,

The company has mentioned the eligibility for performance bonuses in the Employee Manual. It is to be assumed that the company has provided all necessary information to its employees once it issues the Employee Manual. I feel that as an employee, you should be able to abide by the company's rules.

Dear Amit,

I think you are eligible for the performance bonus for two reasons:

1) You are supposed to get it by Jan 07 itself.
2) It's clearly mentioned in your company manual that if the employee is present on the day of the payoff, then he'll get his bonus.

It's better to clarify these points with your HR. If your company says "No," then what's the reason they give you? Maybe they have some other specifications? Please clarify the same with your company.

Hi Binzy,

Thank you for the reply. The company has informed me that they will issue a Performance Bonus from the March salary. I will be with the company until the 19th of March 2007, so I will receive a salary for 11 days. Therefore, I am eligible for the bonus.
