I am working for a software company in Hyderabad. We have our headquarters in the USA. We wanted to sponsor a couple of H1B visas through our US company. Once the H1 is approved, and visa stamping is done, we would depute them to the US to work on client assignments. Until the H1 is approved, the individual will continue working with their current company. Due to the visa processing expenses and travel costs, there is a risk involved if the candidate is not willing to travel to the US after the visa processing or may not report in the US.

I am curious about the practices followed in companies to ensure that candidates join the company. Do they require any deposit or a service agreement?

I kindly request you to provide the necessary information. It would be greatly appreciated.

Agreement is necessary for employees who have been assigned a job at their parent company or client. To arrange this, you need to discuss with your company's advocate and obtain good suggestions.

We have also sent a few of our employees abroad for training purposes. To ensure their continued commitment to the company for a couple of years, we have prepared an agreement. Our advocate has drafted the agreement, so you can cross-check with your company's advocate and obtain his suggestions.

Hi Geentanjali,

Usually, a security deposit is taken from candidates so that even if the H1 stamped individual does not join your company, you will get back the processing fee. The security deposit value varies from company to company.

You could discuss this with your management and decide.

Hi,

This totally depends on company rules and regulations. These decisions are made by the management of the company. Please address this issue directly with them; they will definitely take action in such situations. However, some companies follow agreements, and you can do the same.
