I am facing a problem. I have been working with a company for the last 3 months. The job profile is not what I expected when I joined. I was told it was a technical post, but now I have to do sales as well. I am constantly in a bad state of mind. In the meantime, I have received an offer from a good company with better compensation and a more suitable position. Now, my existing company has come to know about it and is threatening to make my life hell by filing legal and police cases against me for cheating. These are people who have a strong influence in our industry. Now, I am faced with dire problems. I am unsure about my salary for this month as well as my prospects with the new company.

In this case, what should I do? Should I abscond after receiving the joining letter from the new company? I am not receiving my salary in any case. What should I do if I leave? What legal or police action can they take against me? I have not signed any bond or contract.

Please help me out. Your prompt reply may just help me get out of this soup.

Hi,

You seem to be desperate. I don't think there is a need to get so desperate. Just serve the notice period and leave. If possible, take acknowledgment of it. I hope you are not the first employee in the company to leave. Well, regarding their hold in the industry, if they are so high-profiled, will they have time to screw your life? And within three months, have you become so important?

Do as per the terms and conditions of your appointment letter. Make sure no company assets are in your possession as per your company records. Since the present company has influence over the industry, inquire if they have any influence on your new company. Inform your present situation to the new appointment authority and ensure that you are safe in the new place. If you feel that everything is okay, then proceed. Otherwise, since the present company has a good influence over the industry, try to get a job profile as promised and better compensation.

You have just served for three months, you might be on probation. If you are on probation, what about the notice period? If you are required to serve notice, then they can deduct the notice pay from your salary. If you have not done any cheating and you leave the service, they cannot do anything. What police case will they file against you?

Divya: There is no notice period mentioned in the appointment letter. The company just terminated a colleague last week without any notice or compensation. I am very important to them because the software expertise I possess is unique in India.

Parasurampur: There were no terms and conditions specified in the appointment letter. I have already had a meeting with the new company, and they are okay with everything. I have informed them about the current situation.

Mr. Malik: Thank you for your input. I am not on probation. I was hired as an expert in a particular technology that only I am familiar with in India. I am on full payroll with no conditions mentioned in the appointment letter. Thanks again for the reassurance regarding the police case.

Please don't panic. Nothing will happen. You are on probation, so serve as per the appointment order. No police case can be filed. You should just inform your new company about your current proceedings, but I suggest doing that after getting the offer from that company. Many companies just focus on sales jobs. You could have spoken with those who are already employed there to understand their reasons for leaving. It is better to address this issue with someone who is familiar with the industry.

Wait until you receive your salary if you have not signed any contract with them. They can't take any legal action if you are very neat, sincere, and clean in your attitude. Don't worry about this; please take some time from your next company and resign properly.

I think you are in a tight spot. If the new company has no objections to your background, meaning if you are finally selected, just collect the offer letter first. If you are in the notice period, you can serve that period; otherwise, you have to pay in lieu of it only. They have the right to recover this part only. No one can do anything apart from this, so don't fear. Good luck

Nothing happens if you leave a company immediately when your appointment has no expression of a termination clause. Your employer is a bad company. Leave them immediately, and no police or court can entertain them if they intimidate an employee.
