I am working for a Pvt Ltd company in Bangalore. We are primarily into trading industrial products and to some extent assemble machines. My company is not covered under ESIC. The company has crossed 20 employees in Sep 2003, and today we have a strength of 57 employees. I have the following clarifications:
1. Does the Act say, if the number of employees earning less than ₹10,000 per month is less than 10 in an organization, the organization need not be registered under ESI?
2. Can we get the coverage from today onwards, or should we get ourselves registered from 2003 onwards?
3. If from 2003, should all the arrears be remitted to ESIC?
4. Are there any penalty clauses for not getting registered all these years, and what would be the extent of the penalty?

Thank you for posting a reply. The ESIC document was very useful and contains all information. However, I did not understand the applicability of the rule. Should both the below requirements of the rule be looked at separately:
1. Employees drawing less than 10,000.00
2. Employee strength more than 10 employees
OR
Should it be read as the number of employees earning less than 10,000 p.m. is less than 10. Can you please help me out with this.
