Hi all,

Greetings! I need help. Currently, I received my salary hike for the current year. The hike was announced in February 2008, stating that it would take effect after the completion of the joining date to the company, i.e., in September 2008. My friend informed me that labor law states that from April until September, I should be receiving arrears, i.e., the difference between the hiked salary and the one received. I asked my HR, but he rejected it, stating that there is no such rule, we can give a hike at any time and mention that it will take effect upon completion of the date of joining.

Please help.

Regards,
Jeev

Hi Jeev,

You are not clear in your query. Let me explain what I have understood. You mentioned you had a salary hike. Was it oral or written? If it is written, then they would have mentioned the date from which the hike would be effective. Go and talk to your HR, keeping the letter as proof, and ask for the arrears.

If it was just announced, then I think there is no proof of the hike or from which date it is effective. The maximum you can do is talk to your HR and request your arrears. Whenever HR announces a salary hike, the first thing to do is get it in writing. Otherwise, there would be no proof to defend yourself.

Dear Increase in salary shall be effective from the date mentioned in the letter of increase in salary even if the letter is given in April, but clearly stating that the increase will be effective in September. Then, you will receive the increase only from September and not from April.
